2. Applicability

These general terms and conditions apply to all offers, agreements, services, products, programs, workshops, events, and other activities of Connectingmindbodysoul.

By signing an offer, entering into an agreement, or purchasing a service, the client declares to have read and agreed to these general terms and conditions.

Deviations from these terms and conditions are only valid if agreed upon in writing in advance.

3. Offers, agreements, and cooling-off period

All offers are non-binding, unless explicitly stated otherwise.

An agreement is concluded as soon as the client gives written or digital approval to an offer or agreement.

After signing the agreement, a cooling-off period of 24 hours applies. Within this period, the client can cancel the agreement free of charge, solely in writing, unless the execution of the agreement has already started at the client's request.

After this cooling-off period, the agreement is final, and the cancellation conditions apply.

4. Services

Connectingmindbodysoul offers, among others, the following services:

All services are performed on the basis of a best-efforts obligation.

Connectingmindbodysoul does not guarantee the achievement of specific results.

5. Obligations of the client

The client shall timely provide all necessary information and render all necessary cooperation for the proper execution of the agreement.

The client is responsible for the accuracy and completeness of all provided information.

The client remains at all times responsible for the manner in which advice, assignments, exercises, and recommendations from Connectingmindbodysoul are carried out and applied.

Connectingmindbodysoul cannot be held responsible in any way for the results the client may or may not achieve.

6. Prices and payment

All prices are exclusive of VAT, unless explicitly stated otherwise.

Invoices must be paid in full within 7 days of the invoice date, unless otherwise agreed upon in writing.

Connectingmindbodysoul reserves the right to request a down payment or payment in installments.

If the payment term is exceeded, the client is legally in default. All statutory interest, collection costs, and other costs arising from the collection of the outstanding claim are entirely at the expense of the client.

7. Cancellation, rescheduling, and no-show

Cancellation must always be made in writing.

The following conditions apply to cancellation:

• 
  Up to 30 days before the start: 25% of the agreed amount.
  
• 
  Between 30 and 14 days before the start: 50%.
  
• 
  Between 14 and 7 days before the start: 75%.
  
• 
  Less than 7 days before the start or after the start of the program: 100%.
  

After the start of a program, the full agreed amount remains due.

In case of a no-show, regardless of the reason, there is no right to refund, rescheduling, or make-up possibility.

The client is fully responsible for appearing on time for appointments, sessions, workshops, training, and events.

Arriving late does not entitle to an extension of the agreed duration of the appointment.

Sessions, appointments, or program components will only be rescheduled if Connectingmindbodysoul has given prior written consent.

Connectingmindbodysoul is not obliged to honor a rescheduling request.

8. Confidentiality

Both parties shall treat all confidential information shared during the collaboration as strictly confidential.

Only when required by law or when deemed necessary to protect the safety of the client or third parties may this be deviated from.

Reviews, testimonials, and achieved results will only be published with the client's prior consent.

9. Liability

The services of Connectingmindbodysoul are provided on the basis of a best-efforts obligation and are at the client's own expense and risk.

Connectingmindbodysoul gives no guarantees regarding the outcomes or results of the services.

The client remains at all times responsible for all choices, decisions, actions, and the execution of advice, exercises, assignments, and recommendations resulting from the services.

To the extent permitted by law, Connectingmindbodysoul accepts no liability for direct or indirect damage, consequential damage, financial loss, business interruption, emotional damage, loss of profit, or other damage arising from participation in or the use of its services.

If a provision excluding liability does not hold up under mandatory law, any possible liability is limited to a maximum of the invoice amount of the relevant agreement.

10. Force majeure

Force majeure includes, but is not limited to, illness, government measures, pandemics, technical failures, internet outages, power failures, calamities, and other circumstances beyond the reasonable control of Connectingmindbodysoul.

In case of force majeure, Connectingmindbodysoul has the right to suspend or reschedule the execution of the agreement without being liable for any compensation.

11. Intellectual property

All materials provided by Connectingmindbodysoul, including training, workbooks, presentations, videos, texts, images, online programs, and other content, remain the property of Connectingmindbodysoul.

These may not be copied, distributed, published, or commercially used without prior written permission.

12. Privacy

Connectingmindbodysoul processes personal data in accordance with the General Data Protection Regulation (GDPR).

Personal data will only be used for the execution of the agreement, administration, and communication.

13. Applicable law

All agreements and legal relationships with Connectingmindbodysoul are exclusively governed by Dutch law.

Parties will first attempt to resolve any disputes through mutual consultation.

If this proves impossible, disputes will be submitted to the competent court in the district where Connectingmindbodysoul is located, unless mandatory law dictates otherwise.

14. Final provision

By using the services of Connectingmindbodysoul, the client declares to have read and fully agreed to these general terms and conditions.
